Indiana’s sober living homes have the option of gaining certification through Indiana Alliance of Recovery Residences (IARR). There is also a state certification program administered by the Department of Mental Health and Addiction. Both certifications in Indiana remain optional, with little movement to make either mandatory. However, in 2017, a law was passed that made state certification a requirement for sober living homes interested in receiving state and/or federal funding. Forgoing state certification puts Medicaid dollars and any state or federal level grant programs out of reach for non-certified homes. Massachusetts sober living homes are facing a high degree of NIMBY pushback in the community.

D’Amante argued that he did not count as an occupant under the state sprinkler law because he was the building’s proprietor, saying the city’s fire chief had told him so. But Judge Salvidio rejected his argument and said it didn’t address the fact that the property is still zoned as a single-family home, where only three unrelated people can live together. The property’s owner, Caezar D’Amante, told the court he was doing his best to bring the property up to code. But Judge Donna Salvidio pointed out that the city cited him more than a month ago, and D’Amante only started to address the violations in the week leading up to Friday’s hearing. More unpermitted work has continued even after D’Amante was cited, officials said.
Standards
The city has cited the property for unpermitted construction work, running a rooming house without a permit, failing to install fire sprinklers, and failing to make the property accessible. On November 12, 2015, FHWA issued a memorandum indicating that all modifications to NCHRP 350-tested devices will require testing under MASH in order to receive a Federal-aid eligibility letter from FHWA. In addition, a Federal Register Notice was also issued regarding this action.
